Welcome, and thanks for choosing High Ground Property Care LLC (“High Ground,” “we,” “us”). These Terms of Service apply to our website and to the property-care services we provide in the Box Elder and Rapid City, South Dakota area. By using our website, requesting an assessment, or enrolling in a plan, you agree to these Terms.
1. Our services
High Ground provides preventative property maintenance and related services — exterior cleaning, lawn and snow care, gutters, minor repairs, hauling, and documented property condition reports, among others. Specific services are described on our website and in your plan or written estimate.
Trades we do not perform under our own license. We are not a licensed electrical, HVAC, or plumbing contractor. Where a job calls for one of those licensed trades, we coordinate with licensed partners rather than performing that work ourselves.
2. Assessments & estimates
Your property assessment is free and comes with no obligation. Any estimate we give is a good-faith estimate based on the conditions known at the time. Your final price and the exact services included are set out in your plan or written agreement. Conditions we could not reasonably have foreseen — hidden damage, access problems, severe weather — may change the scope or price, and we’ll talk with you before doing that work.
3. Plans & recurring billing
Our maintenance plans are ongoing memberships. Here’s how billing works, in plain terms:
- Monthly, in advance. Plans are billed monthly at the amount stated in your plan agreement.
- Automatic renewal. Your plan continues month to month and your payment method is automatically charged each cycle until you cancel. Plans carry a 12-month commitment unless your agreement says otherwise.
- Your authorization. When you enroll and provide a payment method, you authorize High Ground — through our payment processor, Square — to charge that card or bank account the agreed amount on a recurring basis until you cancel as described below.
- Who handles the money. Payments are processed securely by Square. We do not store your full card or bank-account numbers on our systems.
- Extra work. Work beyond what your plan includes — snow events past your plan’s count, or work beyond your included hours — is billed at your member rate. Routine items like bulbs, batteries, and filters stay included.
- Price changes. We may adjust plan pricing, and if we do we’ll give you at least 30 days’ notice before it takes effect.
- Missed payments. If a payment fails, we may retry it and will reach out. Service may pause until your account is current, and you remain responsible for amounts owed for service already provided.
4. Cancellation & term
You can cancel with 30 days’ notice by email, text, or phone using the contact details below. Cancellation stops future billing after the notice period — we don’t bill you for service after your plan ends. Except where required by law or stated in your agreement, monthly payments already made are not prorated or refunded. If your plan is within its initial 12-month commitment, any early-cancellation terms in your agreement apply.
5. Access, scheduling & weather
You agree to give us safe, reasonable access to the property on scheduled visit days, to secure pets, and to tell us about hazards or locked areas. Scheduling — especially snow, lawn, and exterior work — depends on weather and conditions, and we may adjust timing accordingly. For snow, we respond within the windows described in your plan.
6. Photos & documentation
Documenting our work is part of the service: we photograph your property to build the condition reports you receive. By enrolling, you consent to us photographing your property for that purpose. We use images of completed work in our marketing only with identifying details removed — no address, no personal information — and you can opt out of any marketing use at any time by emailing us.
7. Licensing & insurance
High Ground is veteran-owned, licensed for the work we perform, and insured. A certificate of insurance is available on request. As noted above, regulated electrical, HVAC, and plumbing work is handled through licensed partners rather than under our license.
8. Disclaimers & limitation of liability
We perform our work with reasonable skill and care. To the fullest extent allowed by law, High Ground is not liable for pre-existing conditions or damage we did not cause, for issues arising from inaccurate information or access we were not given, or for indirect, incidental, or consequential damages. To the fullest extent allowed by law, our total liability for any claim relating to our services is limited to the amount you paid us for the specific service giving rise to the claim. Nothing here limits liability that cannot be limited under law.
9. Third-party services
Our website and operations use trusted third-party tools — contact and plan forms are delivered through Formspree, scheduling is handled through Calendly, and payments are processed through Square. Your use of those features is also subject to those companies’ terms and privacy practices.
10. Changes to these Terms
We may update these Terms from time to time. When we do, we’ll change the “last updated” date above. Continuing to use our website or services after a change means you accept the updated Terms.
11. Governing law
These Terms are governed by the laws of the State of South Dakota, without regard to its conflict-of-laws rules.
